Indian compulsory licence demands spreading from #pharma to #greenenergy – #patent

There is a long and complicated tussle over patents in the pharma sector in India. Over the past year, India has issued two compulsory licences for pharmaceuticals and made a number of other moves seen as hostile to patent holders (see this recent article on our , Health Issues India which gives a rundown)

Now, according to Business Line  (part of the respected Hindu newspaper), India plans to do the same thing for wind and solar technology that it thinks it might need. Quite how India would justify this as part of its obligation under international agreements, remains to be seen: the World Trade Organisation TRIPS agreement on intellectual property has some exemptions for medicines needed for public health emergencies. Will India claim that its polluting coal-generation or the wave of diseases predicted to accompany global warming constitute a public health emergency?
